Close call for cuda!

RUSTY Cuda

In over my head!
:( I can't decide wether I'm lucky or unlucky, car is safe(well for now) but the tent will need some mending!
Noticed the tarp(on car) blew off this am, figgered I'd start up the 74 & retarp the 3 while I was out there, got the 74 running after a few tries(still have'nt messed with the resistor) & walked down the side of the 3 to pick up the tarp, looked up a tad & noticed this!

I know she was gettin thin so didn't think much of it, till walking around the car I look up a little higher!
Hmmmm no branches around, WTF!

take a look over the gate & there's the culprit, not as big as the one that fell behind the gate last storm, but big enough to do some damage , this tree is almost as big as one I took down a few years ago for the same reason(LARGE branches falling ) mine was 179" around the base & cost 2K to get rid of!(No the neighdbor won't spend any money he"ll let it fall apart(SIGH!)
If it comes down in total in my direction(about 70' away) both cars are gonners & there not insured!

I understand the no insurance on non running cars but if the tree is your neighbors and it is hanging over your property line then HE is the one who better have good insurance because HE will be the one liable if your cars receive damage from his tree.
 
Well this particular tree does not actually hang over, it's probably 30 ft or so over the line(he has a bunch of others that do:( but this tree has taken a beating the last few storms, dropped a huge one straigh back a few weeks ago, gotta shoot some pics of it , pretty woonded, I'm pretty sure nothing will be done, the(his) yards been overgrown since I moved in 20 somethin years ago!:dgt: Not a lot I can do! Rich.

ABSOLUTELY INCORRECT!!!!!! The liability does NOT fall upon the owner of the tree/ property which it is planted, rather the property that recieves the damage. I'm going thru this exact scenario as we speak, had both insurance adjusters tell me the same thing just 2 days ago ( the result of storm/ tree damage to my home, the car was spared luckily).

You are telling me that a neighbors tree falls on your house and he is not liable for the damage? There ought to be a law.......... :doubt:
 
That is exactly the case, neighbor is not responsible.That kinda sux, but that's insurance companies for ya.
 
I doubt my neighbor is gonna do anything, I don't think the yuards been touched in 20 years(about as long as I've been here) got bored & shot the tree in question today, this is the missing branch that fell last storm, it was about 30 ft long & fell behind the gate!

Same yard from my side, somehow I think it's never gonna change as long as I stay here, the man is elderly but has a son living there to thats younger than me & I doubt he's going anywhere(don't ask) ! SIGH!

I have a backyard neighbor like that - the guy that owns the empty lot next to me that'll never get used for his intended purpose.

Two years ago, I started trimming back the branches from his trees to keep the leaves out of our little inflatable pool. I was eye-balling the really high branches that were hanging all the way into the middle of my yard and figured I couldn't reach them. So, I just followed them back to somewhere I could reach - that was basically the main trunk at about 2 feet above the fence.
It was ALL over in my yard because he had so many trees in his that they grew that way to get to the sunlight. They were "waste" trees grown from dropped seeds from the other trees - and right along the fence line - you know the type.
There were two others behind my shed. One ended up leaning so far into my yard that it's main trunk caught the eaves of the shed and start lifting one corner. Threw the whole front of the shed out of square. My shed would move when there was a decent wind swinging the tree around.
He had them all cut down last year, but now there's a fresh batch growing.
I like trees, but that's a bit ridiculous.

Apparently, trees are part of the reason he bought the empty lot - there were fruit trees there - our neighborhood used to be an orchard. He wanted to preserve the few trees left. Well, the cherry tree finally fell over last year from it's own weight. It's never been pruned. The peach tree was gone the first year after we moved in. The pear tree is still there and is a haven for birds and critters. That's nice but he just lets them fall to the ground and rot. Pretty smell, that.
And the branches that fall? Get piled up at the back of the lot. Nice little skunk den - next to my shed - which they seem to like crawling under...

Ohh I'm pissed off now!
 
Rusty, talk to the town, they might force him to clean up the falling and unsafe trees on his property, also I think you have a right to remove anything that hangs onto your property, especially if it presents a danger to your property. I know that in Parsippany, the town gave me crap if the lawn exceeded 3". They actually had someone come out and give me a written warning to cut it or be fined.
 
Same here in Miami Beach... you let your yard go (front OR rear) and the city will soon be out to your house with a notice. Anything that hangs over on my side is mine. In other words, if I want to cut it I can, if the fruit is on my side, it's mine (which is great because my neighbors have avocado and mango trees...)

Lucky for me, I have great neighbors and we watch out for one another..but if they were assholes whose overgrown shit was screwing up my backyard, there would certainly be mysterious tree deaths along the wall. (from my "accidentally" spilling a few gallons of foliage killer....
 
It's not really hanging over , some buy the fence are but there pines & grow pretty straight up, the branch that hit the tent fell from 60 or 70 feet away, the wind gave it a nice ride, thats why i put up a 6" fence, I don't have to look at the mess! Rich.
